Grievance
A grievance is a dispute between the parties arising out of an interpretation or
application of this Agreement. A grievance may be filed by any Flight Attendant,
group of Flight Attendants or the LEC President. Prior to the filing of a grievance,
the Flight Attendant is encouraged to discuss the matter with the Director of
Inflight or her/his designee in an effort to resolve it. When a written grievance is
filed, it will contain a reference to the provision of this Agreement alleged to have
been breached and a short, concise statement of the facts involved.
B. Discipline and Discharge Grievances
1. A Flight Attendant that is directed by the Company to attend an
investigatory interview or meeting at which the Flight Attendant
reasonably believes may result in disciplinary action may request Union
representation. The Union representative may participate in the
interview or meeting either in person or by teleconference provided the
Union representative is available within two (2) hours of the designated
time of the interview or meeting.
2. A Flight Attendant will not be disciplined or discharged except for just
cause. A Flight Attendant will be notified in writing of discipline or
discharge and the reasons therefore.
3. A Flight Attendant who is disciplined or discharged will be granted a
hearing provided she/he files a written request for a hearing with the
Director of Inflight or her/his designee within fourteen (14) business
days from the date upon which she/he receives written notice of such
discipline or discharge.
4. Such hearing will be held within fourteen (14) business days after the
Director of Inflight or her/his designee receives the written request for
a hearing. Within four (4) business days after receiving the written
request for a hearing, the Union and the Company representatives will
confer to make a good faith effort to agree upon a convenient time and
place for the hearing.
5. Within fourteen (14) business days following the completion of the
hearing, the Director of Inflight or her/his designee will issue a decision
in writing and furnish the Flight Attendant and the Union a copy thereof.
The decision will include a statement of the facts considered and the
reason(s) for the decision.
